Call for comment: General Comment on the Right to Freedom of Movement and Residence
The African Commission on Human and Peoples’ Rights (African Commission) has called for comment on the draft General Comment No. XX on the African Charter on Human and Peoples’ Rights: The right to freedom of movement and residence (draft General Comment).
The right to freedom of movement and residence is contained in article 12 of the African Charter on Human and Peoples’ Rights, and provides in terms of sub-article 12(1) that: “Every individual shall have the right to freedom of movement and residence within the borders of a State provided he abides by the law.” As indicated in the introduction to the draft General Comment, this right is imperative to advance other human rights, including the rights to freedom of association, family, education and work.
